TERMS OF USE

Please read these Terms of Use ("Terms") carefully before using Gardinite's website, mobile applications, and any related services (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.
1. Who we are
These Terms are a legal agreement between you and Gardinite ("Gardinite", "we", "us", or "our").
"Service" means the Gardinite mobile application, website, and any related features or services we provide.
"You" or "User" means any person who installs, accesses, or uses the Service.
2. Acceptance of these Terms
By using the Service, you confirm that:
- You have read and understood these Terms;
- You agree to be legally bound by them; and
- You are old enough and legally able to enter into this agreement under the laws that apply to you (or you have permission from a parent or guardian where required).
If you do not agree to these Terms, you must stop using the Service immediately.
3. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
By using the Service, you agree that we may process your information in accordance with our Privacy Policy.
4. Using the Service
You agree to use the Service only for lawful purposes and in a way that does not harm Gardinite, other users, or anyone else.
You must not:
- Use the Service in any way that violates applicable laws or regulations;
- Attempt to gain unauthorized access to the Service, other user accounts, or our systems;
- Interfere with or disrupt the operation of the Service, including by introducing viruses, malware, or harmful code;
- Use the Service to harass, threaten, abuse, or harm others;
- Use automated tools (such as bots or scrapers) to access the Service in a way that could damage or overload our systems;
- Use the Service to upload or share any illegal, infringing, or otherwise inappropriate content.
If we believe that you are misusing the Service, we may take action, including limiting or ending your access.
5. Accounts and security
Some parts of the Service may allow or require you to create an account.
If you create an account:
- You must provide accurate and up-to-date information;
- You are responsible for keeping your login details private;
- You are responsible for all activity that happens under your account.
If you think your account has been compromised, you should contact us as soon as possible.
We may suspend or close accounts that:
- Violate these Terms;
- Are used for fraud, abuse, or other harmful behavior; or
- Are inactive for a long time, if necessary for security or maintenance.
6. Purchases, subscriptions, and payments
The Service may offer paid features, subscriptions, or one-time purchases.
If you make a purchase through an app store or other platform:
- Prices, billing, and payment processing are usually handled by that platform, not directly by Gardinite;
- Any refunds are generally subject to that platform's own policies;
- You are responsible for reviewing and understanding the app store or platform terms.
We may change prices, features, or available plans over time. Any change will generally apply to future purchases or billing periods.
7. Content and intellectual property
Unless we say otherwise, all content and materials in the Service belong to Gardinite or our licensors. This includes, for example:
- Text, graphics, logos, icons, and images;
- App design, layout, and user interface;
- Software and code.
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Gardinite app on your personal device;
- Access and use the Service for your own personal, non-commercial use.
You must not:
- Copy, modify, distribute, sell, or create derivative works based on the Service or its content, except where allowed by law;
- Remove or alter any copyright, trademark, or other ownership notices;
- Use Gardinite's name, logo, or branding without our written permission.
All rights not expressly granted to you are reserved by Gardinite and our licensors.
8. Content you submit
The Service may allow you to upload, submit, or create content (for example: images, text, notes, or other data, depending on the features you use).
When you submit content:
- You keep any ownership rights you have in that content;
- You are responsible for the content you submit;
- You promise that you have the right to share that content and that it does not break any laws or violate anyone else's rights.
By submitting content through the Service, you give Gardinite a worldwide, non-exclusive, royalty-free license to:
- Use, store, process, display, reproduce, and modify that content as needed to operate, maintain, and improve the Service;
- Show your content within the Service for you and, where applicable, other users.
We may remove or restrict access to content that we reasonably believe:
- Breaks these Terms;
- Breaks the law; or
- Is harmful, offensive, or inappropriate.
We do not have to monitor everything users submit, but we may review and moderate content at our discretion.
9. Third-party services and links
The Service may show, use, or link to content and services from third parties, such as:
- External websites;
- Analytics tools;
- Ads or sponsored content;
- Payment services or app stores.
Gardinite does not control third-party services and is not responsible for:
- Their content;
- Their terms or policies;
- Any damage or loss that may occur from your use of them.
Your use of third-party services is at your own risk and is governed by the terms and privacy policies of those third parties.
10. Availability, changes, and updates
We do our best to keep the Service running smoothly, but:
- The Service may sometimes be unavailable due to maintenance, updates, technical issues, or reasons beyond our control;
- We may change, update, or remove parts of the Service at any time, with or without notice.
We may also release updates or new versions of the app. Some updates may be required for the Service to work properly. In some cases, older versions of the app may stop working or lose access to certain features.
You are responsible for keeping your app and device reasonably up to date.
11. Data, storage, and backups
The Service may store or process certain data related to your use.
While we take reasonable steps to protect and maintain the Service, you understand that:
- Data may be lost, corrupted, or unavailable due to technical issues, failures, or other problems;
- We cannot guarantee that content or data within the Service will always be preserved or recoverable.
You are responsible for keeping your own backups of any important information or content you use with the Service.
12. Termination
We may suspend or terminate your access to the Service, in whole or in part, at any time if we reasonably believe that:
- You have violated these Terms;
- Your use creates a risk to us, the Service, or other users;
- We need to do so for legal, security, or operational reasons.
If your access is terminated:
- Your right to use the Service ends immediately;
- Some parts of these Terms will still apply, including those dealing with intellectual property, limitations of liability, and dispute resolution.
You may stop using the Service and delete the app from your devices at any time.
13. Disclaimer of warranties
To the fullest extent allowed by law, the Service is provided on an "as is" and "as available" basis.
Gardinite does not make any promises or guarantees that:
- The Service will always be available, uninterrupted, or error-free;
- The Service will be secure or free from viruses or harmful components;
- Any information, suggestions, or results provided through the Service will be accurate, complete, or suitable for your specific situation;
- The Service will meet your expectations.
You use the Service at your own risk.
14. Limitation of liability
To the fullest extent allowed by law:
- Gardinite and its affiliates, partners, officers, employees, and licensors are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the Service;
- Our total liability for any claim related to the Service will be limited to the amount you paid to use the Service (if anything) during the twelve (12) months before the event giving rise to the claim, or a reasonable fixed amount where no payment was made.
Some places do not allow certain limitations or exclusions of liability. In those cases, this section applies only to the extent allowed by local law.
15. Indemnification
You agree to indemnify and hold harmless Gardinite and its affiliates, officers, employees, and partners from and against any claims, demands, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Service;
- Your breach of these Terms;
- Your violation of any law or third-party right;
- Any content you submit through the Service.
16. Governing law and disputes
These Terms and your use of the Service are governed by the laws that apply in your place of residence, to the extent that those laws are mandatory and cannot be excluded.
If a dispute arises between you and Gardinite, we encourage you to contact us first so we can try to resolve it informally.
If we cannot resolve a dispute informally, the dispute will be handled by the courts or dispute resolution bodies that have authority under the laws that apply to you.
17. Changes to these Terms
We may update these Terms from time to time.
When we make changes, we will update the "Last Updated" date at the top of this document. In some cases, we may also show a notice within the app or on our website.
By continuing to use the Service after the updated Terms become effective, you agree to be bound by the new version. If you do not agree, you must stop using the Service.
