Terms of Use — Thrift Pilot AI

These Terms of Use ("Terms") govern your access to and use of Thrift Pilot AI (the "App") and any related services (including web login), operated by Gardinite (gardinite.com) ("we", "us", "our"). By creating an account or using the App, you agree to these Terms.

If you do not agree, do not use the App.

1) Eligibility

The App is not intended for children under 13. If you are under the age of majority where you live, you may only use the App with a parent or legal guardian's consent and supervision.

2) Account Registration and Security

You must create an account to use the App. You agree to provide accurate information (including name, username, email, and phone number) and keep it up to date.

You are responsible for maintaining the security of your account and for all activity under your account.

3) What the App Does

Thrift Pilot AI helps you scan and manage item information (including photos and details) and may provide AI-powered results such as categorization, listing drafts, or resale-related insights. Outputs may be inaccurate or incomplete and are provided for convenience only.

4) User Content

You may upload or create content such as item photos, titles, descriptions, categories, pricing info, notes, and community posts ("User Content").

You keep ownership of your User Content. But you grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display your User Content only as needed to:

• operate and provide the App (scan history, AI processing, syncing, community feed)
• show your content to others when you choose to post it publicly (community feed)
• enforce these Terms and keep the App safe

You represent that you have all necessary rights to upload/post your User Content and that it does not violate any law or third-party rights.

5) Community Feed (Public Posts)

The App includes a community feed where users can share content. If you post to the community feed, you understand:

• your post may be publicly visible to other users
• other users may interact with your content (e.g., view, comment, share within the App)
• you should not post private or sensitive information you don't want others to see

We can remove or restrict content or accounts at any time if we believe content violates these Terms, harms users, or creates legal risk.

6) Acceptable Use

You agree not to:

• use the App for unlawful purposes
• post or upload content that is illegal, infringing, deceptive, hateful, harassing, sexually explicit (especially involving minors), or otherwise harmful
• attempt to access other users' accounts or data
• interfere with or disrupt the App (including scraping, abuse, reverse engineering, or bypassing security)
• misuse marketplace integrations (e.g., posting prohibited items or content you don't own)

7) Marketplace Publishing (eBay, Poshmark, and Others)

The App may allow you to connect third-party marketplace accounts and publish/export listings to marketplaces (now or in the future).

At your direction: When you publish/export, we send the listing information you select (e.g., photos, title/description, category/brand, price, optional location) to the marketplace.

Connected accounts: We may store authorization tokens/connection credentials required to post on your behalf. We do not collect your marketplace password.

Third-party rules: Your use of third-party marketplaces is governed by their own terms and privacy policies. We are not responsible for third-party services.

Persistence: Listings may remain on a marketplace even if you delete content in our App or delete your account.

8) Subscriptions, Free Trials, Billing, and Renewals

Some features may require a paid subscription. Purchases are processed through Apple App Store / Google Play, and we use RevenueCat to manage subscription status.

Free trial

A 3-day free trial is available only on the yearly plan (if offered to you at purchase time).

If you start a free trial, you will be charged the yearly price when the trial ends unless you cancel before it ends.

You can manage/cancel trials and subscriptions in your Apple/Google subscription settings.

Auto-renewal and refunds

Subscriptions may auto-renew unless canceled.

Refund requests are handled by the applicable store and subject to its policies and applicable law.

9) Privacy

Your use of the App is also governed by our Privacy Policy. If there is a conflict between these Terms and the Privacy Policy on privacy issues, the Privacy Policy controls.

10) Intellectual Property

The App (excluding User Content), including software, design, features, and branding, is owned by us or our licensors and is protected by intellectual property laws.

We grant you a limited, personal, non-transferable, revocable license to use the App for its intended purpose, subject to these Terms.

11) Termination

You may stop using the App at any time. You can delete scans/content within the App and delete your account (where available).

We may suspend or terminate your access if you violate these Terms, if we believe it's necessary to protect users or the App, or for legal/security reasons.

12) Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

We do not guarantee accuracy of AI outputs, listing suggestions, prices, profitability, marketplace performance, or uninterrupted availability.

13) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, AI OUTPUTS, OR THIRD-PARTY SERVICES (INCLUDING MARKETPLACES).

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

(Some jurisdictions do not allow certain limitations, so these limits may not apply to you.)

14) Changes to the App or Terms

We may update the App and these Terms from time to time. If we make material changes, we may provide notice in the App or on our website. Continued use after changes means you accept the updated Terms.

15) Governing Terms

These Terms apply to the maximum extent permitted by applicable law. Where local law gives you certain rights that cannot be waived, those rights remain in place.
